Terms of Service

These Terms govern your use of the HoopPicks mobile application (the "App") and the website at hooppicks.simple-tech.app. The App is operated by simple-tech.app. By installing, opening, or using the App you agree to these Terms. If you do not agree, do not use the App.
1. Acceptance
Using the App constitutes your binding acceptance of these Terms and of our Privacy Policy, which is incorporated by reference. If you are using the App on behalf of someone else, you represent that you are authorized to bind them.
2. Eligibility
You must be at least 13 years old (16 in the European Economic Area) to create an account. If you are a minor under your local age of majority, you must have parental or guardian consent. The App is rated 4+ in the App Store, but creating an account requires the ages above because of how data is processed.
3. Your account
- One account per person. Do not share credentials.
- You are responsible for activity under your account.
- Choose a username that is not impersonating, harassing, hateful, sexually explicit, or otherwise inappropriate. We may rename or suspend accounts that violate this rule.
- If you believe your account has been compromised, contact us immediately.
4. Acceptable use
You agree not to:
- Use bots, scripts, or automated tooling to play the game, manipulate the leaderboard, or scrape our backend.
- Attempt to reverse-engineer the App, our edge functions, or our database, except where expressly permitted by law.
- Probe, attack, or otherwise interfere with the integrity of our infrastructure (rate-limit evasion, denial-of-service attempts, SQL injection, RLS bypass attempts, etc.).
- Use the App to violate any law or third-party right.
- Impersonate another person or misrepresent your affiliation.
5. Game rules
- One Daily Question is published per UTC date. The cutoff resets at 06:00 UTC; play before that and your submission counts for the prior UTC date.
- Picks become final the moment you submit. Refreshing, force-quitting, re-installing, or signing out does not restore a fresh attempt for the same UTC date.
- Scoring is computed server-side. We will not adjust scores at a player's request, except where a verifiable bug is to blame.
- The leaderboard reflects scores ranked by the App's logic. We may recompute, hide, or invalidate scores produced through cheating, bugs, or rule violations.
- Endless mode runs separately from the Daily Question; "hearts" and the heart-recovery mechanic are part of game balance and may change at any time.
6. No real-money play, no gambling
HoopPicks is a free-to-play skill and trivia game. Players cannot wager real money, redeem in-app currency for cash, or receive prizes of monetary value. The App does not constitute gambling, betting, or a sweepstakes. If we ever introduce in-app purchases, those will be one-way payments via Apple's StoreKit and will not be redeemable for cash under any circumstances.
7. Player data & non-affiliation with the NBA
Statistics in the App (career averages, MVPs, championships, All-Star selections, and so on) are public, factual data derived from publicly available sources. They are presented as factual reference and not under any license from the NBA, the NBPA, any team, or any player.
HoopPicks is an independent project. It is not affiliated with, endorsed by, sponsored by, or in any way officially connected to the National Basketball Association, any of its member teams, or any current or former player. All trademarks and logos referenced are the property of their respective owners. We do not use NBA team or player likeness or trademark in the App's UI; we reference players by name only, in the same way a sports almanac would.
8. Intellectual property
The HoopPicks name, application code, designs, copy, and "Hardwood Amber" visual identity are owned by simple-tech.app and protected by copyright and other intellectual-property laws. You may not copy, modify, distribute, or create derivative works of any part of the App without our prior written permission.
You retain ownership of the username and any text you submit; you grant us a worldwide, royalty-free, non-exclusive license to display that content within the App (for example, on the leaderboard) for as long as your account exists.
9. Termination
- You may terminate at any time by deleting your account from the App's Settings or by emailing us.
- We may suspend or terminate your account if you breach these Terms, abuse the service, or expose us to legal risk. Where practical we will give notice and a chance to remedy.
- Sections 6, 7, 8, 10, 11, and 12 survive termination.
10. Disclaimer of warranties
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy of stats, or uninterrupted availability. We do our best to keep the App working, but we cannot guarantee that it will be error-free, that scores are perfectly accurate every day, or that the service will never be down.
11. Limitation of liability
To the fullest extent permitted by law, in no event will simple-tech.app, its operators, contractors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the App. Our total aggregate liability for any claim arising from these Terms or the App will not exceed the greater of (a) the amount you have paid us in the 12 months preceding the claim, or (b) USD $50.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
12. Governing law & disputes
These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict-of-laws principles. The courts of Montreal, Quebec have exclusive jurisdiction, except where mandatory consumer-protection law in your country of residence gives you the right to bring proceedings locally.
13. Changes to these Terms
We may update these Terms from time to time. When we make a material change we will update the "Last updated" date at the top and surface an in-app notice on the next launch. Your continued use of the App after a change means you accept the revised Terms. If you do not agree to the change, stop using the App and delete your account.
